Soundscape Platform Privacy Policy

KKFARM Co., Ltd. (the service provider of the Soundscape platform, hereinafter referred to as "the Company") highly values the personal privacy of its members and complies with relevant laws and regulations regarding the protection of privacy and personal data. The following is the Company’s Privacy and Personal Data Protection Policy (hereinafter referred to as "this Policy"), which explains what personal data the Company collects, how such data is used, and other important matters related to your privacy. The term "Member" as used in this Policy includes General Members and Distribution Service Members (as defined in the Company's Terms of Service); depending on the functions and permissions used by a Member, the categories of personal data collected, the timing of collection, and the purposes of use by the Company may vary.

1. Acquisition of Personal Data

  • Information concerning personal identity: When you register as a Member of the Soundscape platform and use the Soundscape platform, the Company may collect or aggregate your personal data, such as personal identity data (e.g., name, date of birth, etc.) and contact information (e.g., telephone number, email address, or correspondence address). Furthermore, when you apply for services requiring real-name verification or financial settlement (e.g., applying to become a Distribution Service Member), the Company may separately collect or aggregate identity verification data (including ID cards or passports, such as ID numbers, passport numbers, and registered permanent addresses) and financial information (such as financial account names and account numbers).

  • Information concerning personal activities on the Soundscape platform: When you use the Soundscape platform, the Company may collect or aggregate information such as your source channels (e.g., recording the source channel for using the service) and technical data such as URLs, IP addresses, browser types, operating system data, languages, device information (e.g., device identifiers or similar identification information), visit times, location data, etc., as well as platform usage records such as usage history and search data.

  • The aforementioned usage records may include (depending on the functions you use and the analysis tools enabled at the time) user behavior data such as page navigation paths, time spent on pages, operation events (clicks/swipes/scrolls), error events, and performance data. The Company may also use user experience analysis or user behavior tracking tools for interface operation recording or screen recording playback (e.g., user screen recording) to assist in debugging and improving service quality. If screen recording playback is conducted, the Company will take reasonable measures to reduce the risk of identifying specific individuals (such as masking specific fields, de-identification, or other appropriate processing). However, please understand that if you proactively provide personal data in input-entabled fields or content, it may still be recorded in the usage records.

2. Use of Personal Data

The data collected from you by the Company will be used for the following purposes:

  • The basic personal data you provide (such as name) will serve as the basis for determining member identity; the contact information you provide will be used for contact or other update notifications related to the Soundscape platform.

  • The scanned files of your personal ID card or passport (if you apply for services requiring real-name verification, such as applying to become a Distribution Service Member) will be used by the Company to verify the identity of Members under the real-name verification system of the Soundscape platform, so as to confirm that the Mmember account corresponds to your true identity.

  • Your usage data and technical data on the Soundscape platform will be used to improve the services provided by the Soundscape platform or to develop new services. The aforementioned purposes may include user experience analysis, interface and process optimization, system performance monitoring, troubleshooting, statistical analysis, and cybersecurity risk detection; the Company may perform analysis, aggregation, or generate statistical results through automated means.

  • The financial account information you provide (if it involves payment or settlement of funds) will be used for the payment of relevant funds by the Company to you.

3. Third-party Service Providers, Commissioned Processing, Disclosure, and Cross-border Processing

The processing and utilization of the aforementioned information may be conducted by the Company's affiliated companies or other partners, or may occur outside of Taiwan. To provide, maintain, or improve the Soundscape platform, the Company may entrust third-party service providers to provide website/product analysis, user experience analysis, user behavior tracking, system monitoring, cloud infrastructure, or other related services. Such providers may, under the Company’s instructions, process the aforementioned usage data, technical data, or other necessary data (such as data collected through third-party analysis or tracking tools) within the scope of such commissioned processing.

Unless there are exceptions under applicable laws and regulations, the Company will not use this information for purposes other than those stated in this Policy. The Company will also not disclose a Member's personal data to third parties without the Member's prior consent, except where disclosure is required by law due to major national interests or to cooperate with investigations by judicial or law enforcement agencies.

The Company will take reasonable administrative and technical measures to protect your personal data and, when entrusting third parties for processing, will require the commissioned processors to comply with confidentiality and security obligations within the scope of their entrustment. The aforementioned processing and utilization may also take place in regions outside of Taiwan (e.g., the location of the entrusted service provider's servers).

4. Data Retention Period

The Company will retain your personal data for the period necessary to achieve the purpose of collection; if laws require a different retention period, or if the Company has a need to retain the data for the performance of contracts, handling of disputes, maintenance of security, or compliance with laws, it will be retained in accordance with relevant laws or within the necessary scope.

5. Rights of Data Subjects

  • You may personally inquire, copy, or request correction of personal data belonging to you. If the applicant is not the account holder, or if the Company has not yet verified the applicant’s identity as the account holder, the applicant may not request to inquire, copy, request for inspection, or apply to correction of personal data or account services that do not belong to their account. In cases other than those described above, you must provide relevant personal data and written documentation when necessary, so that the Company can assist in processing your request.

  • You may personally request to stop the utilization of or delete your personal data; however, once stopped or deleted, you will no longer be able to use the services provided by the Soundscape platform.

  • The Company reserves the right to refuse your request to change, delete, or modify personal data when it hinders major national interests, hinders a public authority from executing statutory duties, or hinders the significant interests of the collecting agency or a third party.

6. Cookies and Similar Technologies

The Company may use cookies or similar technologies (such as pixel tags, SDKs, local storage, or similar mechanisms) to maintain normal service operations, conduct security protection, perform statistical analysis, understand service usage, and improve user experience. The aforementioned technologies may be provided by the Company or third-party service providers.

You may manage, delete, or refuse cookies through browser or device settings; however, if you disable some cookies or similar technologies, it may affect some functions or the user experience of the Soundscape platform. If the Company provides opt-out, preference settings, or other choice mechanisms for specific analysis or experience improvement tools, the methods will be explained on the relevant pages of the Soundscape platform or in the announcement of Policy updates; you may also contact the Company through the contact information provided in this Policy.

7. Security of Personal Data

  • To protect your privacy, the Company provides necessary technologies and measures to protect your personal data.

  • Please keep your personal data, registration account, and other information required at login properly to prevent unauthorized disclosure or access. When using the Soundscape platform on a personal or non-personal computer, please log out or close the software and browser windows when necessary or after use to prevent your data from being stolen.

  • You agree that the data retained on the Soundscape platform shall be accurate and consistent with the facts. If you subsequently discover that your personal data has been used illegally by others or if there are any abnormalities, you should notify the Company immediately.

  • You agree that when using the Soundscape platform, the data provided and used are legal and do not infringe upon the rights of third parties, violate third-party agreements, or involve any illegal acts. If the use of the service results in damage to a third party, the Company shall not be liable for compensation unless there is intentional misconduct or gross negligence on the part of the Company.

8. Amendments and Validity of the Privacy and Personal Data Protection Policy

  • The Company will update this Policy from time to time and comply with applicable laws and regulations related to privacy and personal data protection. When the Company makes significant changes, they will be announced on the Soundscape platform.

  • This Policy constitutes a part of the Terms of Service. If you do not agree to any terms of this Policy or the content of its amendments, please stop using the service immediately.

If you wish to exercise the rights under Section 5 "Rights of Data Subjects," or if you have any questions regarding the Company's privacy or personal data protection policy, please contact support@soundscape.net. To protect the security of your account and personal data, the Company may, within a reasonable scope, require you to provide necessary identity verification information and will process the request in accordance with relevant laws and the Company's operational procedures after verification.
